Before the enactment of the Companies Act 2013, not a single person was able to set up a company. An OPC has the characteristics of a company and the benefits of a sole proprietorship. Earlier if a person had to set up a business then he should opt for sole proprietorship only.
As per Section 2 (62) of the Companies Act 2013, a company can be formed with only 1 director and 1 member. Person company registration in India is a type of entity having lower compliance requirements as compared to a private limited company.
A-One Person Company Registration in India can be obtained under the Companies Act 2013 with only one member and one director. Directors and members can also be the same person. Here a person who can be a resident or non-resident Indian can register an OPC in India.
