Trademark Objection

Trademark objection is one of the earliest steps in the trademark registration process. Trademark objection does not mean outright refusal; Instead, the Registrar of Trademarks seeks a valid reason or explanation regarding the mark and registration. The applicant is given an opportunity to explain how the said trademark meets the criteria for obtaining valid registration.

Trademark examination report

After the trademark registration application is submitted and examined by the Trademark Officer, an examination report is sent to the trademark applicant. It is also placed on the website of the Trademark Office along with the details of the trademark application.

In case of objection raised by the Trademark Examiner, the applicant or an authorized agent gets a chance to submit a reply to the Trademark test report along with the rebuttal.

The feedback is then considered, and if the objection can be waived based on the applicant's response, the trademark application is accepted for registration. The trademark gets published in the journal.
